1. About these terms
These Terms of Service govern your use of the Movo marketplace at https://movo.com.my, operated by MOVA Technologies Inc. (“Movo”). By creating an account or placing an order you accept these terms.
2. Marketplace model
Movo is a multi-vendor marketplace built on WordPress + WooCommerce + Dokan. Products are sold by independent third-party merchants (“Merchants”). Movo provides the platform, payment routing, and dispute mediation. Movo is NOT the seller of record for goods listed by Merchants. Each Merchant warrants the legality, quality, and accuracy of their listings.
3. Customer eligibility
You must be at least 18 years old, a resident of Malaysia, and provide accurate information. One natural person, one account.
4. Commission structure
Movo retains 20% of every order as platform commission. The Merchant receives 80%. Phase 2 splits the 20% internally as 12% to Referral Partner (where applicable), 2% to Customer cashback, and 6% to platform net. The Merchant always sees their 80% share; the internal split is transparent to them. See Refund Policy for refund handling.
5. Cashback Wallet
2% of every order total is credited to your Movo Cashback Wallet after a 7-day refund buffer. Cashback can be applied as a 1:1 MYR discount at checkout, capped at 20% of the order total. Cashback never expires. Refunding an order that earned cashback debits the wallet (negative balance allowed and is paid down by future cashback). Cashback cannot be withdrawn to cash.
6. Referral Partner programme
Single-tier, lifetime, 12% commission on referee orders. Activation requires KYC (MyKad + bank account verification). Referee binding is immutable. Movo reserves the right to deactivate a Referral Partner who violates these terms (e.g. self-referral via secondary accounts, fraudulent IC submission). Multi-level or pyramid structures are expressly prohibited per the Malaysian Direct Sales and Anti-Pyramid Scheme Act 1993.
7. Orders & payment
Phase 2 launches with Cash on Delivery (COD) as the sole payment method. Stripe / FPX / card payments are planned for Phase 3. Orders are placed against Merchant inventory; Movo does not hold stock.
8. Disputes
Customer-Merchant disputes go to the Merchant first via the Merchant store contact. If unresolved within 7 days, Movo mediates. See Refund Policy.
9. Acceptable use
You agree not to: (a) submit fraudulent IC numbers; (b) create multiple accounts; (c) self-refer; (d) misuse the platform for spam, harassment, illegal products, or other prohibited activity per CONTEXT.md compliance gates (e.g. cross-border NPRA-required cosmetics, MOH-required food imports, halal-required food).
10. Account termination
We may suspend or terminate your account for breach of these terms, fraudulent activity, or by request. Cashback Wallet balance and Referral Wallet pending payouts forfeit if account is terminated for fraud.
11. Liability
Movo provides the marketplace AS IS. We disclaim liability for product defects beyond what Malaysian Consumer Protection Act 1999 requires. Our maximum liability is the amount you paid Movo (not including Merchant goods cost) in the previous 12 months.
12. Governing law
These terms are governed by the laws of Malaysia. Disputes resolved in Kuala Lumpur courts.
